Understanding Time Periods for Utah’s ARD Status

Utah Code § 41-6a-401 establishes that the operator of a motor vehicle who has reason to believe that he or she may has been involved in an accident resulting only in damage to another vehicle or other property can move the vehicle off the roadway to the nearest safe location and remain at the scene of the accident or nearest location until that person has fulfilled the statutory requirements described below. If a driver believes that he or she may have been involved in an accident resulting in damage to another vehicle or other property only after leaving the scene of the accident, that person must immediately comply as nearly as possible with the statutory requirements described below.

If the other vehicle or property is operated, occupied, or attended by any person or if the owner of that vehicle or property is present, the operator of the vehicle involved in the accident is required to give the following to the persons involved:

  • the operator’s name, address, and the registration number of the vehicle being operated; and
  • the name of the insurance provider covering the vehicle being operated including the phone number of the agent or provider.

Upon request and if available, the operator is also obligated to exhibit his or her driver’s license to:

  • any investigating peace officer present;
  • the operator, occupant of, or person attending the vehicle or other property damaged in the accident; and
  • the owner of property damaged in the accident, if present.

An operator of a vehicle who provides the required information to an investigating peace officer at the scene of the accident is exempt from providing the information to other required persons. If the vehicle or other property damaged in the accident is unattended, the operator of the vehicle involved in the accident must:

  • locate and notify the operator or owner of the vehicle or the owner of other property damaged in the accident of the operator’s name, address, and the registration number of the vehicle causing the damage; or
  • securely attach in a conspicuous place on the vehicle or other property a written notice giving the operator’s name, address, and the registration number of the vehicle causing the damage.

When an accident results in property damage to an apparent extent of $1,500 or more, the operator of the vehicle involved in the accident must immediately and by the quickest means of communication available give notice or cause to give notice of the accident to the nearest office of a law enforcement agency.
