Sexual Abuse of a Minor Charges in Salt Lake County

In regards to the offense of sexual abuse of a minor, Utah Code § 76-5-401.1 defines a minor as a person who is 14 years of age or older, but younger than 16 years of age, at the time the alleged sexual activity occurred. A person who is four or more years older than the alleged victim and holds a position of special trust can be charged with this crime if he or she does any of the following with the intent to cause substantial emotional or bodily pain to any person or with the intent to arouse or gratify the sexual desire of any person regardless of the sex of any participant:

  • touches the anus, buttocks, or any part of the genitals of the minor;
  • touches the breast of a female minor;
  • otherwise takes indecent liberties with the minor; or
  • causes a minor to take indecent liberties with the alleged offender or another person.
