A vehicular homicide charge, no matter what the circumstances, comes with extremely harsh sentencing in the state of Utah. Vehicular homicide does not in fact suggest that you intentionally caused a death, but it does allege that you should have known that a fatal outcome was possible or likely.
With this being the case, there is very little wiggle room when defending your name in a scenario such as this. Considering the severity of the situation, it is vital that you collaborate with a qualified criminal defense attorney who can capably advise you throughout the entire criminal process.

Vehicular Homicide under Utah Code
Vehicular homicide is the primary charge filed in connection with fatal accidents that are suspected to be DUI-related. According to Utah Code §76-5-207, it is considered vehicular homicide should the defendant be convicted of operating a motor vehicle in a negligent manner that causes the death of another, while either impaired by drugs and / or alcohol or with a blood alcohol concentration (BAC) over the legal limit of .08 percent.
With regard to the allegation itself, the state of Utah considers a case of vehicular homicide to be either a third degree felony or second-degree felony, depending on the situation. In most instances, a second degree felony would only be charged if the alleged offender has another prior conviction on his or her criminal record, or if there are “aggravating” factors present.
An “aggravating” factor may be an extremely high BAC, reckless driving, reckless operation in a construction zone, if the victim was a law enforcement officer, or if the driver had three or more previous drunk driving conditions. If you are acting in a “grossly negligent” manner, you may be charged with aggravated vehicular homicide.
The presumptive sentence for a third degree felony is a prison term of up to five years and / or fines of up to $5,000.
As for a second-degree felony, the presumptive sentence is up to 15 years in prison and / or fines of up to $10,000.
