Under Utah Code § 76-3-407, a person may received increased penalties if he or she is a repeat sexual offender. A repeat and habitual offender is a person who has just one sexual offense and is convicted of another.
The prior sexual offenses referred to in the statute include:
- Unlawful sexual conduct with a minor
- Rape
- Object rape
- Sodomy
- Forcible sexual abuse
- Sexual abuse of a child
- Aggravated sexual assault
- Enticing a minor over the Internet
Any felony offense in another state, territory, or district of the United States that is similar enough to constitute a felony for a sexual offense in Utah’s Criminal Code also applies.
