Rape under Utah Law

According to Utah Code §76-5-402, a person commits rape when the actor (offender) has sexual intercourse without the victims consent.

It is also stated that this law applies whether or not the actor is married to the victim.
Rape in Utah is considered a felony in the first degree with a varying prison sentence depending on the specifics of the case. If it was a basic rape case without additional factors, the presumptive sentence will be “not less than 5 years and which may be for life.” This may also include fines of up to $10,000.

If it is found that, during the rape, the defendant caused serious bodily injury to another, the sentence will be 15 years to life in prison and the possibility of fines up to $10,000.

There is the possibility of a “life without parole” sentence if the defendant is found to have been previously convicted of a grievous sexual offense.
