Repeat and Habitual Sex Offender

Under Utah Code § 76-3-407, a person may received increased penalties if he or she is a repeat sexual offender. A repeat and habitual offender is a person who has just one sexual offense and is convicted of another.

The prior sexual offenses referred to in the statute include:

  • Unlawful sexual conduct with a minor
  • Rape
  • Object rape
  • Sodomy
  • Forcible sexual abuse
  • Sexual abuse of a child
  • Aggravated sexual assault
  • Enticing a minor over the Internet

Any felony offense in another state, territory, or district of the United States that is similar enough to constitute a felony for a sexual offense in Utah’s Criminal Code also applies.

Penalties for Conviction as a Habitual Sexual Predator

Each past felony sexual offense conviction will add five years to the maximum penalty of every felony sexual offense charge you are facing today. As first degree felonies have a maximum sentence of life imprisonment, the habitual sex offender statute applies only to second and third degree felony sexual offenses.

These sexual offenses include those listed in Utah Code § 76-5-401 through 414, sexual exploitation of a minor (§ 76-5b-201), and the felony offense of enticing a minor over the Internet (§ 76-4-401).
